1. Acceptance of Terms

By accessing or using 2am.to ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2am.to is a product operated by 2am.tech (2amigos Consulting Group, LLC), a software development and consulting company. References to "we," "us," or "our" refer to 2amigos Consulting Group, LLC and its subsidiaries.

2. Description of Service

2am.to provides URL shortening, link management, and analytics services. The Service allows users to create shortened URLs, track link performance, generate QR codes, and manage links through a web interface and API.

The Service is provided by 2am.tech as part of our suite of professional software solutions.

3. User Accounts

3.1 Registration

To use certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are responsible for safeguarding your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms, without prior notice.

4. Acceptable Use

4.1 Prohibited Activities

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe upon intellectual property rights
• Distribute malware, viruses, or harmful code
• Engage in phishing, spam, or fraudulent activities
• Create links to illegal content, pornography, or hate speech

4.2 Content Responsibility

You are solely responsible for the content of the URLs you shorten and the destinations they point to. We reserve the right to remove any link that violates these Terms.

5. Service Plans and Billing

5.1 Subscription Plans

We offer various subscription plans with different features and limits. Plan details and pricing are available on our Pricing page.

5.2 Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred under your account.

5.3 Refund Policy

Annual subscriptions may be eligible for a refund within 30 days of purchase. Monthly subscriptions are non-refundable. Contact support@2am.to for refund requests.

5.4 Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Price changes will not affect your current billing cycle.

6. Service Availability

6.1 Uptime

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. Scheduled maintenance will be announced in advance when possible.

6.2 Data Backup

While we maintain regular backups, you are responsible for maintaining your own backup copies of any important links and data.

7. Intellectual Property

7.1 Service Ownership

The Service and its original content, features, and functionality are owned by 2am.tech and are protected by international copyright, trademark, and other intellectual property laws.

7.2 User Content License

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your shortened URLs for the purpose of providing the Service.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. API Usage

9.1 API Access

API access is subject to rate limits based on your subscription plan. Excessive use may result in temporary or permanent API access suspension.

9.2 API Keys

You are responsible for keeping your API keys secure. Do not share your API keys publicly or embed them in client-side code.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL 2AMIGOS CONSULTING GROUP, LLC (2AM.TECH) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless 2amigos Consulting Group, LLC (2am.tech) and its affiliates from any claims, losses, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.
